SPOKE Tennis (“SPOKE”, “we”, “us”) is owned by Ronan Glennane and based in Neutral Bay, Sydney. By using SPOKE, the app, the website or anything we arrange, you agree to these terms. If you’re using SPOKE for a child, you agree to them on the child’s behalf.
Everything SPOKE shows about conditions — heat, UV, air, smoke, wind, rain, radar, storms, sun, shade and glare, for any hour and any court — is a guide to help you plan. It is an estimate, not a measurement, not a promise and not advice. Our calls (like “Should be right” or “Coin toss”) are a reading of the forecast and the radar, and they will sometimes be wrong. SPOKE never tells you whether to play. That is always your decision.
Alerts and notifications, including rain heads-ups, may be late, wrong or not arrive at all. Don’t rely on them for safety.
Use your own judgement and look at the court and the sky yourself. If you feel dizzy, sick, confused or stop sweating in the heat, stop playing, get into the shade, cool down and get medical help. If you hear thunder or see lightning, get off the court.
Shade and glare are calculated from the sun’s position and from aerial height maps of the buildings and trees around a court (Google’s Solar API). Those maps are taken on one date and can be years old. Trees grow, are pruned or are cut down; buildings, fences, shade sails and screens go up or come down; the court’s position or the way it runs can be slightly off. So shade can arrive earlier or later than shown, be lighter or heavier, or not be there at all.
Weather comes from the Bureau of Meteorology, Open-Meteo (a blend of the Bureau, ECMWF and other models), the rain radar and the NSW Rural Fire Service. Forecasts can be wrong, and conditions on court can differ from those nearby.
Tennis is a physical, recreational activity. Like any sport it carries risks, including slips, falls, sprains, strains, overuse injuries, being hit by a ball or racquet, heat illness, sunburn, and injury from court surfaces, nets, fences, lights or weather. Some of these risks are obvious and some aren’t. You take part at your own risk.
Check with a doctor before you start if you have a health condition, or are unsure whether you’re fit to play. Parents and carers are responsible for deciding whether their child plays, and for supervising them.
We don’t take court bookings or payments for courts. Bookings stay with each club or venue, on their own booking page and under their own terms. The venue provides the court and is responsible for it — the surface, nets, lights, gates, facilities and what happens on site.
Court details, prices, hours, court numbers and booking links come from venues, public sources and our own visits, and may be out of date. Check with the venue before you go.
Coaches listed on or matched through SPOKE are independent. They are not our employees, agents or contractors, and we don’t supervise their lessons. Before a coach is listed we check their photo ID, that they hold a current Working with Children Check, and that they hold a coaching qualification, as shown to us at that time. We don’t check anything else, and we don’t vouch for a coach’s ability, conduct or results.
Any lesson, price, payment, cancellation or dispute is between you and the coach. Players pay coaches directly. Parents and carers remain responsible for their children before, during and after any lesson. If you have a concern about a coach’s conduct with a child, contact the NSW Police or the Office of the Children’s Guardian, and tell us.
Last-minute lessons: a player who books a spare spot and doesn’t turn up twice can be removed from last-minute lessons.
The SPOKE Method is one approach to learning tennis, based on our experience. It isn’t the only way, and it doesn’t promise any result: how a child progresses depends on the child, the coach and many other things.
Prices, totals and dates shown for the two-year plan are averages and estimates, and can change. The calculator is a guide only, based on the figures you put in. Lessons are given by a coach we arrange, who is independent of SPOKE as above.
Registering interest costs nothing and doesn’t guarantee a spot. Once a spot is confirmed: lessons are paid term by term, in advance. Up to two sick days a term are made up, and so are lessons cancelled for rain. Make-up lessons are held in the school holidays, at times arranged with you. Other missed lessons aren’t refunded or made up, unless the law requires it.
Gear guides, racquet sizes, prices and string suggestions are general information, not advice for your situation. Prices and product details come from retailers and change often. Check with the retailer before you buy.
We don’t check the identity or background of players. You choose who you add to your circle and who you play with, and you’re responsible for your own safety when you meet them.
Don’t use SPOKE to break the law, harass anyone, post false reports, or try to get at other people’s details or our systems. We can suspend or remove anyone who does.
To the extent the law allows, SPOKE Tennis and its owner are not liable for any loss, injury, damage or cost arising from: relying on the guide (including shade, glare, heat, radar and weather readings, calls and alerts); a venue’s courts or facilities; the acts or omissions of a coach, a venue or another player; the SPOKE Method or any lesson; gear or advice; or using SPOKE. We are never liable for indirect or consequential loss, such as lost time, travel costs or lost bookings.
Where the law doesn’t allow liability to be excluded but allows it to be limited, our liability is limited, at our choice, to supplying the service again or refunding what you paid us for it.
For recreational services, and to the extent allowed by section 139A of the Competition and Consumer Act 2010 (Cth) and the Civil Liability Act 2002 (NSW), our liability for death or personal injury is excluded. This doesn’t exclude liability for significant personal injury caused by gross negligence.
Nothing in these terms limits rights you have under the Australian Consumer Law or any other law that can’t be excluded.
SPOKE is free to use, except for lessons you book. We may change, add to or stop parts of it, and update these terms; the date at the top shows the latest version.
These terms are governed by the law of New South Wales, Australia.
